Many homeowners think that temporary rentals are no longer possible since the Fixed Rental Contracts act. Permanent contracts, indefinite-term rent protection, tenants who refuse to leave – the stories are grim. And so, the property remains empty while you're abroad or waiting for it to be sold. But temporary rentals are still possible.

The law includes recognized exceptions for owners who want to rent out their property temporarily. With the right contract, you rent out your property and are guaranteed to get it back. Completely legal, legally sound. We advise you on which contract type suits your situation and handle the entire process – from finding a suitable tenant to handing over the keys upon your return.

Options for temporary rentals

Interim lease (with Diplomatic clause)
For owners who are temporarily staying elsewhere and intend to move back into the property after the rental period. By including a diplomatic clause, you agree on a fixed period in advance. The tenant is not entitled to an extension and must vacate the property upon the owner's return.

Suitable for: Expat assignments, world travel/sabbatical, study abroad.
Rentals to specific target groups
Since the Fixed Rental Contracts Act, temporary rentals (max. 2 years) are only permitted for legally defined target groups. The lease agreement ends automatically after the agreed term, provided the landlord confirms this in writing in a timely manner.

Suitable for: Rentals to students, home seekers in an emergency situation, or tenants who temporarily live elsewhere due to renovation.
Rental under the Vacancy Act
When a home is vacant for sale, renovation or demolition, the Vacancy Act offers the possibility to temporarily rent out without the tenant being entitled to full rent protection. This does require a permit from the municipality.

Suitable for: Homes for sale, investment properties just before a redevelopment.

Is temporary rental still possible after the Fixed Lease Contracts Act?

Yes. The law has recognized exceptions, including Type C Intermediate Rent for owners who are temporarily staying elsewhere and rentals with a diplomatic clause. Regular temporary contracts of up to two years have largely been abolished, but these two options remain fully permitted.

How quickly will my home be rented out?

On average, it takes three to four weeks from the first consultation to a signed lease. Through our network of relocation agents and international employers, we immediately reach the right target group.

What if my tenant refuses to leave?

In the case of a properly drawn up contract, the tenant is not entitled to an extension. The tenant knows in advance that the rental will end on a certain date and has agreed. We ensure that the contract is legally watertight, so that you can stand strong in the event of a dispute.
